CCW Safe Policy Update Review 2024
By Attorney Marc J. Victor
April 1, 2024
Last year, we reviewed CCW Safe’s policy and pointed out things we liked (they covered acts of self-defense that arose out of domestic violence cases) and things we did not like (no coverage for invalid CCW permits or accidental discharges). Overall, we felt that they still had several exclusions that prevented you from getting the legal assistance you need in a self-defense shooting.
In November 2023, CCW Safe Updated their membership agreement, supposedly removing some of their unnecessary restrictions…or did they?
In this CCW Safe updated policy review, we are going to cover some key points:
Key Points:
- Inconsistencies Between the Old Agreement and the Updated Agreement
- Questionable Coverage Definition for Substances That Alter Judgment
- New Coverage for Bringing Your Firearm Through TSA Security
- Same Exclusions in the Updated Agreement
Inconsistencies Between the Old and Updated Agreements
After comparing the old and updated CCW Safe Member Agreements, we discovered several inconsistencies, with certain exclusions included in the old agreement but removed from the new agreement. Only when you look up their FAQs on their website or contact CCW Safe directly can they confirm whether these instances are covered or not.
This raises the question: How confident can you be that CCW Safe will cover you even if their exclusions or coverage terms are not clearly documented in their membership agreement?
Exclusions that were in the old agreement, but NOT in the updated agreement, that CCW Safe says they WILL NOT COVER:
- No coverage for unintentional discharge
- No coverage for an expired or invalid CCW permit
Exclusions that were in the old agreement, but NOT in the updated agreement, that CCW Safe says they WILL NOT COVER:
- No coverage for unintentional discharge
- No coverage for an expired or invalid CCW permit
Exclusions that were in the old agreement, but NOT in the updated agreement, that CCW Safe says they WILL NOT COVER:
- Prohibited possessor status
- Incidents occurring in gun-free zones.
Questionable Coverage Definition for Substances That Alter Judgment
The first significant change in the CCW Safe Member Agreement update is that they now offer coverage if you are alleged to be impaired by alcohol or drugs. Previously, this coverage was not available. Now, individuals who drink or use drugs can get coverage if they need to use their firearm in self-defense. However, they must prove that their actions were indeed in self-defense while under the influence of drugs or alcohol.
Under Restrictions, Limitations, Notices, and Exclusions
“CCW Safe will not deny plan benefits for an otherwise Covered Use of Force Self-Defense incident because the member is alleged to be impaired.”
What if you are actually impaired? I mean it certainly does not take much to be impaired to the slightest degree. If you are actually impaired maybe one slightly, is that going to be sufficient for CCW Safe to drop you? It certainly appears that way to me, but I do not know how CCW Safe is going to interpret this.
New Coverage for Bringing Your Firearm Through TSA Security
CCW Safe members now receive a new membership benefit for accidentally carrying a firearm through TSA security at an airport or any other travel location with a TSA checkpoint.
“Covered TSA Violation” means any unintentional civil violation of the Transportation Security Administration’s (TSA) security regulations involving the possession of a firearm, firearm parts, ammunition, or other weapon belonging to and contained in the member’s carry-on baggage or on the member’s person, discovered during the airport security screening and inspection process…"
This new coverage addition aids individuals who carry their firearms almost everywhere and may accidentally forget they have them when passing through TSA security.
Same Exclusions in the Updated Agreement
CCW Safe still has some of the same exclusions in the updated member agreement, such as:
- No coverage in Washington, New Jersey, and New York
- No coverage for “on-duty” police officers, private investigators, or security professionals

Summary
It is great that CCW Safe has expanded its coverage, offering more protection for its clients. However, it is concerning that there are aspects where their coverage is not mentioned in the actual policy, even though they claim to provide it. This inconsistency is a major red flag and something to watch out for when choosing a program for legal representation.
