What are Red Flag and Emergency Orders?
Attorneys On Retainer (“AOR”) believes that you deserve to have the benefit of competent representation if you are served with an order that results in the temporary seizure of any firearm you otherwise lawfully possess or prevents your otherwise lawful possession or acquisition of any firearm. Such orders go by a variety of names, including Red Flag Orders (“RFOs”) or Extreme Risk Protection Orders (“ERPOs”). Red Flag Laws allow family members, certain community members, and law enforcement officers to petition a court directly for an RFO, which temporarily restricts an individual’s access to guns if they are found to present a significant risk of harming themselves or others.
Currently, 21 states and the District of Columbia have enacted RFO laws. Like most protective and restraining orders, courts may issue emergency and non-emergency RFOs. Ex parte orders are emergency orders that may be issued by a court when the threat of harm is imminent, while final orders are issued after notice is given to the respondent and a hearing is held where the respondent has the opportunity to contest the order. Ex parte orders differ from final orders in duration and what must be proven to obtain an order.
What Red Flag and Emergency Order Coverage Do We Offer?
The Attorneys On Retainer offers its members up to $15,000 in legal representation coverage for defending against or challenging Red Flag Orders (“RFOs”) or other similar orders that temporarily restrict a member’s access to firearms. This will include coverage on injunction hearings, orders of protection, or orders prohibiting harassment, whether obtained ex parte or at a contested hearing. AOR is committed to upholding your right to due process. We believe that everyone deserves the opportunity to defend themselves in court without having their firearm confiscated prior to their appearance or before a thorough mental health evaluation is conducted.
