Andy Marcantel Discusses AOR Member’s Valid Act of Self-Defense on Armed American Radio | 06-22-2025

Criminal defense attorney Andy Marcantel joins Armed American Radio to break down the case involving Eric Salisbury.

The Incident

While guarding a preschool in Portland, Oregon, Eric Salisbury observed a man, later identified as Manuel Garza, driving erratically through the preschool’s parking lot. After Mr. Garza parked in a neighboring parking lot, Mr. Salisbury approached Mr. Garza’s vehicle to record his license plate. However, Mr. Garza exited his vehicle and charged Mr. Salisbury. Mr. Salisbury, in fear of his life, discharged his firearm in self-defense. Mr. Garza later died in the hospital from his wounds.

Jurisdiction Challenges and Prosecutor’s Letter

Attorneys at The Attorneys For Freedom Law Firm (AFF) approached it with precision and diligence. They enlisted expert investigators and thoroughly analyzed the scene. The prosecutors’ decline letter was strong. While such letters are typically vague and avoid directly affirming the defendant’s actions, this case was different. The prosecutors explicitly stated that the security guard acted in justified self-defense and had no viable alternative.

“If this happened in our home state of Arizona, this guy would be a hero… But because it happened in Portland, we really had to fight this thing.”

Confrontation Debates

One of the most discussed aspects of the case was whether Mr. Salisbury was right to approach the suspect after he parked. Attorney Marcantel addressed this stating that Mr. Salisbury was legally justified. He also pointed out that had Mr. Salisbury done nothing and something tragic occurred, public sentiment would be very different.

“Seconds before the final confrontation, Garza attempted to run over Mr. Salisbury with his car. That’s not just erratic driving, that’s attempted aggravated assault with a deadly weapon.”

The Importance of Legal Coverage for Responsible Gun Owners

Mr. Salisbury’s case emphasizes that self-defense doesn’t end when the threat is neutralized. It often marks the beginning of the legal process. Even the most justified use of force can lead to criminal charges and civil liability. That’s why having skilled, experienced legal defense on your side isn’t just important – it’s essential.
