If two or more AOR members are criminally charged in the same matter, the attorneys will determine whether a conflict of interest exists. If a conflict of interest exists, the attorneys will determine whether such conflict is waivable. If the conflict is waivable, a written waiver will be fully explained by the attorneys and presented to the AOR members involved. If the AOR members involved each execute the written waiver, the representation will proceed as to each AOR member. If the attorneys determine a non-waivable conflict exists, such as in a case where each AOR member implicates the other, each AOR member will be provided independent non-conflicted legal counsel.
