We may modify these Terms at any time. If we do, we will update the “Last Modified” date above. The amended Terms will be effective immediately upon posting, and your continued use of our Website constitutes your acceptance of the revised Terms. If you do not agree to the amended Terms, you must stop using our Website. Your continued membership in AOR, if applicable, constitutes your acceptance of the revised Terms.

You must be at least eighteen (18) years of age to access or use our Website. By using our Website, you represent and warrant that you meet this eligibility requirement.

III. LEGAL INFORMATION & ATTORNEY-CLIENT RELATIONSHIP

The information on our Website is for general purposes only and is not legal advice. Simply using our Website does not make you a client of any attorney. You become a client of The Attorneys For Freedom Law Firm (“AFF”) only after we complete a conflicts check and you execute AFF’s Legal Services Agreement.

 

IV. ELECTRONIC COMMUNICATIONS AND SMS MESSAGING

By using our Website, and, if applicable, becoming a member of AOR, you consent to receive electronic communications from AOR related to our Website, AOR, and AOR’s activities, including communications delivered via email, newsletters, or other electronic means.

If you voluntarily subscribe to AOR’s SMS/text messaging services by providing your mobile phone number, you consent to receive periodic text messages about AOR, reminders to complete your registration, helpful information for completing your registration, pertinent information about developments in the law, as well as marketing communications. Everyone who joins AOR signs an engagement agreement to become a client of AFF and must provide a phone number and consent for AOR and AFF to contact you via SMS/text or push for account-related communications and legal representation, as applicable. AOR will also utilize that phone number to communicate with you regarding your account, including confirmation of your membership status, account-related updates, billing or payment notifications, AOR’s affiliate program, membership benefits, policy information, and other service-related communications directly related to your AOR membership. AFF will utilize your phone number to communicate with you regarding any covered legal matter that may arise. As a member of AOR and client of AFF you may not opt out of these communications.

AOR will utilize that phone number to provide you with newsletters and pertinent information and updates regarding developments in the law. AOR may also utilize that phone number to provide promotional codes or other marketing information to AOR members. Consent to receive these informational and marketing communications via SMS/text message or push is not a condition of membership in AOR or any purchase. AOR members may opt out of marketing SMS/text or push messages at any time by replying STOP to one of our text messages, phoning us at (866) 404-5112, emailing us at marketing@attorneysforfreedom.com, or through any other reasonable means. Neither AOR nor participating wireless carriers guarantee message delivery. AOR reserves the right to modify or discontinue SMS messaging services at any time without notice.

 

V. ACCOUNTS, CREDENTIALS, AND SECURITY

Only current members of AOR are permitted to create a user account to access protected areas of our Website. If you create an account or access protected areas of our Website:

  • You are responsible for maintaining the confidentiality of your login credentials.

  • You may not share your username or password with others.

We reserve the right to suspend or terminate accounts that appear to be shared, compromised, or used in violation of these Terms.

 

VI. USER CONTENT

Our Website may allow users to create, post, store, or share content, including text, images, graphics, videos, comments, and other materials (“User Content”). By posting content on our Website, you represent and warrant that:

We have no obligation to allow users to utilize our Website for User Content, but if we do, while we have no obligation to monitor User Content, we expressly reserve the right to remove or delete User Content at any time for any reason or no reason, with or without notice.

You may not create, post, submit, store, or share any User Content that is confidential or proprietary, or that you do not have all necessary rights and permissions to disclose.

You further agree that you will not create, post, submit, store, or share any User Content that:

  • Is unlawful, defamatory, obscene, pornographic, indecent, lewd, sexually explicit, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, or fraudulent;

  • Would constitute, encourage, or provide instructions for a criminal offense, violate the rights of any party, or otherwise create liability or violate any local, state, national, or international law;

  • Infringes or misappropriates any patent, trademark, trade secret, copyright, intellectual property, or other proprietary right of any party;

  • Contains statements, representations, or claims that do not reflect your honest views, opinions, or experiences;

  • Impersonates any person or entity, or misrepresents your affiliation with any person or entity;

  • Contains unsolicited promotions, advertising, endorsements, or solicitations;

  • Contains any private, personal, or identifying information of a third party without that party’s express consent;

  • Contains any viruses, malware, corrupted data, or other harmful, disruptive, or destructive files or code; or

  • In AOR’s sole judgment, is otherwise objectionable, restricts or inhibits any other person from using or enjoying our Website, or may expose AOR or others to harm, liability, or risk of any kind.

Enforcement of this Section is solely at AOR’s discretion. Failure to enforce this Section or any part thereof in any particular instance does not constitute a waiver of AOR’s right to enforce this Section or part thereof in other instances, nor does it estop AOR from asserting any of its rights or obligations at any time.

Nothing in these Terms creates any private right of action on the part of any third party or any reasonable expectation that our Website will be free of content that violates these rules.

 

VIII. OWNERSHIP AND LIMITED LICENSE

Our Website and all content therein are owned by AOR or its express licensors and are protected by the laws of the United States of America and international intellectual property laws, as applicable.

Subject to your compliance with these Terms, you are granted a limited, nonexclusive, nontransferable, revocable license to access and use our Website for the purposes consistent with AOR’s purpose and mission only. Unauthorized use terminates this license.

 

IX. TRADEMARKS

The Attorneys On Retainer Association and its associated logos, slogans, product names, and our Website’s look and feel are trademarks of AOR and may not be copied, imitated, or used, in whole or in part, without our prior written permission. Moreover, The Attorneys For Freedom law firm and associated logos, slogans, product names, and our Website’s look and feel are trademarks of AFF and may not be copied, imitated, or used, in whole or in part, without our prior written permission. All other trademarks, registered trademarks, product names, and AOR’s names or logos mentioned on our Website and AFF’s website are the property of their respective owners. Reference to any products, services, processes, or other information by trade name, trademark, manufacturer, supplier, or otherwise does not constitute or imply endorsement, sponsorship, or recommendation by us.

 

X. FEEDBACK

Any feedback, ideas, or suggestions you submit (“Feedback”) may be used by AOR for any purpose without compensation or obligation. Feedback is nonconfidential.

 

XI. COPYRIGHT COMPLAINTS (DMCA)

You agree to provide accurate billing information and authorize us to charge applicable fees. All fees are non-refundable unless otherwise stated. We reserve the right to change pricing, suspend access for non-payment, and terminate memberships for violations of these Terms.

 

XIV. TERMINATION

We may suspend or terminate your access to our Website, accounts, memberships, or related services at any time, with or without notice, for violations of these Terms or for any other reason permitted by law.

 

XV. DISCLAIMERS

You use our Website at your own risk. We provide the Website ‘as is’ without any guarantees or warranties. We do not guarantee that our Website will be error-free, virus-free, or available at all times. In addition, AOR does not represent or warrant that our Website is accurate, complete, reliable, current, or error-free. While AOR attempts to make your use of our Website safe, we cannot and do not represent or warrant that our Website or servers are free of viruses or other harmful components. XVI. LIMITATION OF LIABILITY

XVII. GOVERNING LAW, FORUM, AND VENUE SELECTION, WAIVER OF JURY TRIAL

All matters in controversy related to these Terms shall be adjudicated in a court of competent jurisdiction in Maricopa County, Arizona, and you hereby consent to the personal jurisdiction of such courts.

YOU HEREBY WAIVE YOUR RIGHT TO A TRIAL BY JURY WITH RESPECT TO ANY CLAIM, ACTION OR PROCEEDING, DIRECTLY OR INDIRECTLY, ARISING OUT OF, OR RELATING TO, THESE TERMS TO THE FULLEST EXTENT PERMITTED BY LAW.
