In a self-defense case, there could be an irregularity in the court proceedings or newly discovered evidence that the attorneys need to present to the court, this causes a retrial. The retrial may favor the opposing party and result in a different outcome than the original trial. For most people, the retrial costs extra because their attorney needs to represent them in court again, which adds to the overall cost. One of the benefits of becoming an AOR member, is that you’ll receive retrial coverage. Having Retrial Coverage means you won’t have to pay for attorney services, if your case has to be retried.

 

What Is a Retrial?

A retrial is a judge setting aside the original verdict and giving both parties the opportunity to prove their innocence of all or specific matters of the case that has already been reviewed in the original trial. Retrials occur for several reasons, typically involving the same parties and issues as the original trial. It is essential to note that not all cases that go to retrial will necessarily lead to a different verdict.

Grounds For a Retrial May Include:

  • A mistrial in the previous trial
  • An appeal
  • Newly discovered evidence
  • Constitutional violations
  • Juror misconduct
  • Prosecutorial misconduct and more

 

How Does Retrial Coverage Benefit Me?

Typically, a retrial will incur more attorney fees because you will need attorney representation, because it is a new trial. If your self-defense plan has retrial coverage you will not need to pay these extra fees out of pocket.
